Electronic Cigarette Co’s Win FDA Court Battle
It official, the FDA (Food & Drug Administration) does not have regulatory powers over electronic cigarettes.
In a ruling by a Washington Federal court, the judge critised the FDA for overstepping their authority in seizing imports of electronic cigarettes by two importers and by trying to regulate the industry.
In his ruling the judge agreed with the electronic cigarette submission and said that electronic cigarettes were the ‘functional equivilent of traditional cigarettes’
The FDA recently gained the power to regulate tobacco products but as electronic cigarettes do not contain tobacco ( or the carcinogens contained therin!) then they were not within the remit of powers of the FDA to regulate.
Electronic cigarettes supplied by inlife LLC are the only company so far to manufacture their refill cartridges in an FDA registered laboratory and by so doing have their ingredients independently verified.
